Good question and i could come down to a couple of different things... and it also depends on whether or not the Hospital was there before the drain.
From an engineering prospective, the drain would actually be apart of the hospitals infrastructure, drainage being a neccesity for the hospitals structual liability, even if it wasn't initially built when the hospital was first constructed, it may have always been in the plan, if that being the case, it could technically become their responsibility to ensure the drain does what it was intended to do.
That being said however, the crew that have built these obstacles haven't actually built anything that would disrupt the flow of water, if anything they've possibly helped the situation by extending the walls.

Other factor and probably the more obvious ones are simply noise complaints or general liability issues. Overall though, the advice given in regards to being kicked out is on point and I hope Jay and the crew can resolve the issue and continue to build what is turning out to be an epic spot!
